if pornhub buys tumblr while the deals pending ill take all my art off this godforsaken site and yall should too bc their company has a policy that legally owns whatever work you upload to it
WOW i didn’t expect my personal post as a heads up if i start removing my art in the future to blow up but YEAH thank u! mindgeek is super fucking shady and notorious for stealing and exploiting content and dmcas are a nightmare that end up doxxing everyone that tries to take down their content and it’s overall definitely not a company i’d like my (entirely sfw!) art to be associated with, let alone possibly have the rights to. i’ve had a lot of art theft already, and i don’t need it to be more difficult.
obviously a deal hasn’t been made yet, but the company is very openly wanting to buy tumblr and if that happens i’m removing all my art from this website, and depending on any changes they make i’ll likely just leave the site completely. i for one was enjoying the nsfw ban and less bots…….
after the nsfw ban awhile back pornhub was encouraging artists to post their digital art to their site because it was ~welcomed~ and everyone then found out their tos/agreement is a nightmare and they basically own everything on their sites owned by mindgeek and could do what they wanted with your art/potentially profit off of it. also, again, i do not want my art associated with a porn company. at all.
this is also a huge way in which they fuck over sex workers
sex worker has a cam show/private video/etc, some asshole records it, uploads it to pornhub, woops they own it now lmao better luck next time

Deviantart doesn’t own the content you post, and neither does Pornhub. The policy you are referring to is an industry standard on every piece of social media out there.
Taken from the Pornhub TOS:
“For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to the Websites, you hereby grant the Websites a worldwide, irrevocable, perpetual, non-exclusive, royalty-free, sublicenseable and transferable license to use, exploit, reproduce, distribute, prepare derivative works of, display, communicate, and perform the Content in connection with the Websites’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Websites (and derivative works thereof) in any media formats and through any media channels. You also waive to the full extent permitted by law any and all claims against us related to moral rights in the Content. In no circumstances will we be liable to you for any exploitation of any Content that you post. You also hereby grant each user of the Websites a non-exclusive, royalty free license to access your Content through the Websites, and to use, reproduce, distribute, display, communicate and perform such Content as permitted through the functionality of the Websites and under these Terms of Service. The above licenses granted by you in video Content you submit to the Websites terminate within a commercially reasonable time after you remove or delete your videos from the Websites. So, no. Pornhub does not legally own content you post on their site. In fact, there’s no legal way for them to be able to do that. What this means is that they’re allowed to use and distribute the content you post for advertising, repost it on one of their other sites, or reformat them to fit different pages. It’s what allows other users to be able to share someone’s original post without their prior expressed consent.
And if you think you’ve been safe from this up until now, I’m sorry to say this has always been the conditions you’ve been posting your art under.
Per Tumblr’s terms of use:
“When you provide Subscriber Content to Tumblr through the Services, you grant Tumblr a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, host, store, cache, reproduce, publish, display (publicly or otherwise), perform (publicly or otherwise), distribute, transmit, modify, adapt (including, without limitation, in order to conform it to the requirements of any networks, devices, services, or media through which the Services are available), and create derivative works of, such Subscriber Content. The rights you grant in this license are for the limited purposes of allowing Tumblr to operate the Services in accordance with their functionality, improve and promote the Services, and develop new Services. The reference in this license to “creat[ing] derivative works” is not intended to give Tumblr a right to make substantive editorial changes or derivations, but does, for example, enable reblogging, which allows Tumblr Subscribers to redistribute Subscriber Content from one Tumblr blog to another in a manner that allows them to add their own text or other Content before or after your Subscriber Content.“
I can provide these clauses from the TOS of Pixiv, Newgrounds and Twitter too, if need be.
